These Terms govern your use of HARD TICKET (the platform artists use to run their sites, stores, and fan lists) and of Fan Pass. They are one agreement in three parts: general terms for everyone, Fan Pass terms for fans, and additional terms for artists.
Please read the Dispute Resolution section carefully. It requires most disputes to be resolved by individual arbitration, waives your right to a jury trial and to participate in a class action, and gives you 30 days to opt out.
By creating an account or Fan Pass, accessing an artist's HARD TICKET-powered site, or otherwise using the services, you agree to these Terms and the Privacy Policy. You must be at least 13; if you are between 13 and the age of majority, you may use the services only with a parent or guardian's involvement.
The services serve two user types with different terms: Artists (paying customers who run a site, store, and fan CRM) and Fans (end users who visit, buy, RSVP, and may create a Fan Pass). Part A applies to everyone; Part B to Fans; Part C to Artists.
HARD TICKET is a multi-tenant software platform that lets artists build fan sites, sell merch, collect RSVPs, manage a fan CRM, and send permitted messages, plus Fan Pass (an identity service).
HARD TICKET is not a merchant, seller, marketplace, promoter, or party to any transaction between an artist and a fan. Each artist is an independent business solely responsible for its products, content, and communications. HARD TICKET does not endorse or guarantee any artist, fan, or content.
You agree to provide accurate information and to safeguard access to your account, including any device or passkey used to authenticate. Notify us promptly of any unauthorized use. You may not impersonate anyone or use another user's account without permission.
You retain ownership of content you upload. You grant HARD TICKET a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, and display your content solely to operate, provide, secure, and improve the services. You are responsible for your content and represent you have the rights to it.
You will not use the services to: break the law or infringe others' rights; post unlawful, defamatory, fraudulent, obscene, exploitative (including any CSAM, which we report), harassing, or hateful content; send spam or violate CAN-SPAM or the TCPA; upload malware or attempt unauthorized access; scrape or build a competing product; sell, broker, or resell fan personal data; misrepresent your identity; or sell illegal, counterfeit, or unauthorized goods. We may remove content and suspend or terminate access for violations.
The platform, software, and the HARD TICKET and Fan Pass names and logos are owned by HARD TICKET; artists retain rights in their own name, music, and artwork; fans retain rights in their own content (each subject to the license above).
We respond to copyright notices under the DMCA (17 U.S.C. 512). Send notices to our designated agent; we forward valid counter-notices and terminate repeat infringers.
Payments for artist sales are processed by Stripe under the artist's own Stripe account; HARD TICKET does not store full card numbers and is not a party to the artist's Stripe agreement. Your use of any third-party service (Stripe, messaging/email providers, connected social/identity providers) is governed by that provider's own terms. HARD TICKET is not responsible for third-party services.
For fan data an artist collects through the CRM and messaging tools, the artist is the controller and HARD TICKET is the processor. For the Fan Pass identity account and platform operations, HARD TICKET is the controller (see the Privacy Policy). Fan Pass uses passkeys; any biometric check happens on your device. HARD TICKET does not receive or store your biometric data.
Every purchase, RSVP, or subscription a fan enters on an artist's site is solely between the fan and the artist. The artist is the seller and merchant of record; payments settle directly to the artist's Stripe account and HARD TICKET does not hold or disburse those funds. The artist is responsible for products, fulfillment, refunds, taxes, and consumer-protection obligations. Disputes over an artist's products are between the fan and the artist.
Email and SMS to an artist's fans are sent by and on behalf of the artist, who is the sender and is responsible for obtaining consent, honoring opt-outs (STOP for SMS, unsubscribe for email), and complying with the TCPA and CAN-SPAM. HARD TICKET provides consent/suppression tooling and may operate in a transactional-only sending mode and gate promotional sending.
The services are provided "as is" and "as available," without warranties of any kind to the maximum extent permitted by law. HARD TICKET is not liable for indirect, incidental, or consequential damages, and its total liability is capped at the greater of the amounts you paid HARD TICKET in the prior 12 months or US$100. Because fans typically pay HARD TICKET nothing, a fan's remedy against HARD TICKET is limited to US$100; a fan's dispute over an artist's product is with the artist. Some jurisdictions don't allow certain limitations, and nothing limits liability that cannot be limited by law.
You will defend and indemnify HARD TICKET from claims arising out of your content, your use of the services, your violation of these Terms or law, and (for artists) your products, transactions, messaging, and data practices. You may stop using the services at any time; HARD TICKET may suspend or terminate access for violations, legal risk, or discontinuation. Provisions that should survive termination do.
These Terms are governed by the laws of the State of Tennessee and the Federal Arbitration Act. Before arbitration, the parties will try to resolve a dispute informally for 60 days. Except for small-claims and IP/injunctive matters, disputes are resolved by final and binding individual arbitration; you and HARD TICKET waive class actions and jury trials. You may opt out of arbitration within 30 days of first accepting these Terms. If you are a consumer, nothing deprives you of mandatory consumer protections of your home jurisdiction.
We may update these Terms; for material changes we'll give reasonable notice, and continued use after the effective date means acceptance (arbitration changes don't apply to disputes already noticed). These Terms, the Privacy Policy, and (for artists) the DPA and Order Form are the entire agreement. The parties are independent contractors; there are no third-party beneficiaries; unenforceable provisions are severed.
A Fan Pass is a free, optional account that recognizes you across participating artists without a separate password each time; you own your identity. It uses passkeys (WebAuthn); biometrics never leave your device. Each artist independently controls its own marketing relationship with you: consenting to one artist doesn't consent you to another. You can export or delete your Fan Pass data at any time. "Sign in with HARD TICKET" is an OIDC identity service; if you later use it with a third-party app, you authorize sharing only the attributes you approve, and you can revoke connections.
Each artist is an independent business and the sole seller/merchant of record, responsible for its products, fulfillment, refunds, taxes, disclosures, and messaging compliance, and for maintaining its own Stripe account. The artist is the controller of fan data it collects (HARD TICKET is the processor under the DPA), must obtain required consents and honor opt-outs, and will not sell or broker fan personal data. Subscription fees, renewal, and wind-down/data-export are set in the artist's Order Form.
